Terms of Use

These terms govern the use of the GigCal app (web, iOS and Android), the marketing website and the widget. By creating an account or using the app you accept these terms. If you do not accept them, please do not use the app. Please also read the Privacy Policy and the Refund Policy, which form part of these terms.
1. Service provider and acceptance of the terms
The GigCal service is provided by:

(hereinafter "we", "GigCal" or "the provider"). "You" are the person using the app, whether as an individual or on behalf of a band. If you use the app on behalf of a band, association or company, you confirm that you are authorised to bind them to these terms.
2. Description of the service
GigCal is software as a service (SaaS) for bands and musicians. Depending on the plan, it includes:
- the band's gig calendar with role-based briefings (each member sees the text and call time intended for their role), the rule that a band cannot have two gigs on the same day, gig offers and clash detection before accepting;
- a personal calendar: personal gigs outside the band, blocks and invitations to external musicians;
- earnings per member (private) and band income/expenses for management, in RSD and EUR;
- the Network: public profiles of bands and musicians, search by city, instrument, event type and date, gig invitations and membership requests;
- the widget for the band's website with a public availability calendar (paid add-on);
- push notifications, an .ics feed for your phone's calendar, light and dark theme.
The service evolves: we may add, change or remove features (see section 14). We strive to keep the app running continuously but do not guarantee uninterrupted availability — maintenance and upgrades are occasionally needed, of which we will give advance notice where possible.
3. Account and accuracy of data
- An account is required to use the app. You sign in with a one-time code sent to your email; you may optionally set a password.
- You must be at least 16 years old.
- The data you enter (email, name, phone, band details) must be accurate and up to date. You may not impersonate another person or band.
- You are responsible for keeping access to your email, password and signed-in devices secure, and for everything done through your account. You can review and revoke active sign-ins in the app. If you suspect misuse, notify us immediately.
- One person — one account. One account can be a member of several bands.
- You can delete your account at any time (Bands / Profile → Account → "Delete account") or by email to [[EMAIL]].
4. Bands, roles and membership
- A band (a "tenant" in the app) is created by a user who thereby becomes its owner/administrator ("management"). Management manages members, roles, gigs, band finances, the widget and the band's subscription, and is responsible for what the band enters into the app — including data about clients and organisers.
- Members join a band by invitation or approved membership request and see what is intended for their role. Management may change a member's role or remove a member; a member may leave the band.
- Each band is a separate entity with its own subscription. Band data belongs to the band, not to an individual member; when a member leaves, the band's gigs and data remain with the band.
- Management must inform members and third parties whose data it enters that the data is processed in GigCal, and must have a basis for entering it.
5. Acceptable use
You may use the app only in accordance with the law and these terms. It is not permitted to:
- enter false, misleading or someone else's data, or data you have no right to enter;
- use the Network for unsolicited messages (spam), harassment, threats, hate speech or advertising unrelated to music engagements;
- post content that infringes others' rights (copyright, trademark, privacy) or is unlawful;
- attempt unauthorised access to other users' accounts, bands or data; circumvent role, subscription or security restrictions;
- bulk-download data (scraping), overload the servers, introduce malicious code, or use the API and widget in ways not intended;
- resell or rent access to the app without our written consent;
- use the widget from domains not approved for your band or modify it to show other people's data.

6. User content and licence
- Everything you enter into the app — band data, gigs, descriptions, images, rate cards, messages — remains yours (or the band's). We claim no ownership of your content.
- So that we can provide the service, you grant us a non-exclusive, royalty-free, worldwide licence to store your content, copy it (including backups), adapt it for display (e.g. resized images) and show it to those it is intended for: band members, other users in the Network if you enabled a public profile, and visitors of the band's website via the widget to the extent the band configures. The licence lasts while the content is in the app, i.e. until the backup deletion period expires.
- You warrant that you have the right to use the content you enter in this way (e.g. that you hold rights to band photos).
- We may remove content that violates these terms or the law; as a rule we will notify you.
7. Network, public profiles and relations between users
- A public profile in the Network is optional. You choose what you publish and can turn it off at any time.
- GigCal is a tool for finding and organising — we are not a party to agreements between bands, musicians, clients and organisers. Engagement terms, fees, payments and performance of a gig are agreed between users, who are solely responsible for them. We do not verify users' identity, qualifications or reliability unless expressly stated.
- Fees and earnings in the app are records you keep yourself; GigCal does not intermediate payments between users.
- Messages in the Network (invitations, requests) are to be used solely for music engagements and membership.
8. Free trial, subscriptions and pricing
8.1. Free trial
Every new account and every new band gets a 30-day free trial with full features. No card or payment is required for the trial. After the trial, a subscription is required for the features listed in 8.2.
8.2. Plans
- Band — the band's subscription: calendar, briefings, offers, band finances, Network for the band. Paid by the band (management). Band members who only play with the band pay nothing. A band administrator with an active subscription is also covered for personal features.
- Individual — for musicians: visibility in the Network and personal gigs outside a band. Needed only if you use those features and are not covered by a band.
- Widget — a per-band add-on for the public calendar on the band's website.
- Each band has its own subscription; one user can manage several bands.
8.3. Prices and billing
- The prices shown in the app at the time a payment request is created are authoritative. Prices on the website are indicative ("from").
- Billing is monthly or yearly; a yearly subscription is charged as 10 monthly payments (two months free). Prices are in RSD; the EUR figure is informative, using the exchange rate shown in the app.
- Promo codes are valid under the conditions stated with the code (percentage or fixed discount, validity and number of uses) and cannot be exchanged for cash.
- We may change prices; a change applies to new periods, never to a period already paid. We will give at least 30 days' notice in the app or by email.
8.4. Payment by bank transfer (current method)
- You create a payment request in the app and receive a payment slip with an IPS QR code and a payment reference. You pay through your bank; we do not receive card details.
- We activate the subscription manually once the payment is recorded, as a rule within 1–2 business days. The expiry date is shown in the app.
- There is no automatic renewal. The subscription is valid until its expiry date; to continue, you create a new payment request. We will remind you before expiry.
- We issue the invoice to the details you enter in the request (name/company, address, tax ID if any).
8.5. What happens on expiry
When the trial or subscription expires your data is not deleted: viewing the calendar and data remains available, but changes (new gigs, editing gigs, public profile, widget) are locked until a subscription is activated. If a subscription has not been renewed for more than 12 months, we may notify you and then archive or delete the band's data, giving at least 30 days to export it.
9. When card payments are enabled (Paddle)
We plan to enable card payments through Paddle. From the moment that option becomes available in the app, the following applies:
Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- The purchase is made through Paddle (Paddle.com Market Ltd, United Kingdom, or Paddle.com Inc., USA, depending on your location), which is the seller and issues the invoice; Paddle's buyer terms also apply to the purchase (paddle.com/legal/checkout-buyer-terms). Paddle calculates and remits VAT/sales tax for your country.
- Subscriptions paid by card renew automatically at the end of each period (monthly or yearly) at the then-current price until you cancel.
- You can cancel at any time — in the app or through Paddle. Cancellation takes effect at the end of the current paid period; you keep full access until then. There is no cancellation fee.
- If a charge fails, Paddle will retry; if it still fails, the subscription moves to expired status (section 8.5).
- Refunds for Paddle purchases are governed by the Refund Policy and Paddle's rules.
10. Purchases through the App Store and Google Play
If you buy a subscription inside the iOS or Android app through the Apple App Store or Google Play (when and if that option is available), billing, renewal, cancellation and refunds are handled by that store under its rules. You manage the subscription in your Apple ID or Google account settings; we cannot cancel or refund a purchase made through a store — contact Apple or Google for that. Apple and Google are not parties to these terms and have no obligations to you regarding GigCal other than those they provide themselves.
11. Termination and suspension
- You may stop using the app and delete your account at any time.
- We may temporarily suspend or permanently terminate an account or band if you seriously or repeatedly violate these terms, if required by law, or if necessary for the safety of other users or the system. Where reasonable, we will warn you first and give you time to remedy the problem.
- In case of termination for violation of the terms you are not entitled to a refund for the remaining period. If we permanently discontinue the service for other reasons, we will refund the proportional part of any prepaid subscription.
- Provisions that by their nature survive termination (the licence for backups until the deletion period expires, limitation of liability, governing law) remain in force.
12. Intellectual property
The GigCal app, its code, design, logo, name and documentation are our intellectual property or that of our licensors and are protected by copyright and trademark law. You receive a limited, non-exclusive, non-transferable right to use the app in accordance with these terms. You may not copy, modify, decompile or create derivative works of the app except to the extent expressly permitted by law. You may embed the widget only on websites you have approved for your band. We may freely use feedback and suggestions you send us to improve the service.
13. Disclaimer of warranties and limitation of liability
- The service is provided "as is" and "as available". To the extent permitted by law, we give no warranty that the app will operate without interruption or error, or that it will meet your every need.
- GigCal is an organisational aid. You, or the band, are responsible for the accuracy of the gigs, times, addresses, fees and earnings entered. We recommend verifying important data and keeping it outside the app as well (e.g. the .ics feed).
- To the extent permitted by law, we are not liable for indirect damage, lost profit, missed gigs or engagements, data loss caused by your actions, or the conduct of other users. Our total liability to you on any basis is limited to the amount you paid us for the service in the 12 months preceding the event giving rise to the damage.
- Nothing in these terms excludes liability that cannot be excluded by law, including liability for intentionally caused damage and rights consumers have under mandatory law.
14. Changes to the terms and the service
We may change these terms. We will notify you of material changes at least 15 days in advance in the app or by email, unless a change is required by law or for security and must take effect immediately. The date of the last change is shown at the top. If you disagree with the changes, you may stop using the service and delete your account before they take effect; continued use afterwards means acceptance of the updated terms. We may improve, change or discontinue features of the service; if we discontinue a feature that is the essence of a paid plan, we will refund the proportional part of the subscription for the remaining period.
15. Governing law and dispute resolution
- These terms and any relationship between you and us are governed by the law of the Republic of Serbia.
- We will try to resolve disputes amicably — write to us at [[EMAIL]]. If no agreement can be reached, the competent court in [[GRAD SEDIŠTA]], Republic of Serbia, has jurisdiction.
- If you are a consumer residing in the European Union, you retain the protection of the mandatory consumer-protection rules of your country and the right to bring proceedings before the courts of your country; you may also use the EU online dispute resolution platform (ec.europa.eu/consumers/odr). Consumers in Serbia may contact the ministry responsible for consumer protection or bodies for out-of-court resolution of consumer disputes.
- If any provision of these terms is found invalid, the remaining provisions stay in force.
- These terms exist in Serbian and English; in case of discrepancy the Serbian version prevails.
